FOX FITNESS LIABILITY WAIVER AND RELEASE OF CLAIMS

I understand and acknowledge that participation in fitness training, gym activities, and martial arts instruction—including but not limited to strength training, cardiovascular exercise, boxing, kickboxing, Brazilian Jiu-Jitsu, Muay Thai, wrestling, self-defense training, sparring, and conditioning drills—involves inherent risks of injury.

ASSUMPTION OF RISK

I voluntarily choose to participate in all activities offered by Fox Fitness, including the use of equipment, training facilities, and participation in martial arts classes and instruction. I understand these activities may involve physical contact, strenuous exertion, and the risk of serious injury, including but not limited to sprains, strains, fractures, concussions, cuts, bruises, or more severe injuries.

I acknowledge that these risks cannot be completely eliminated, even with proper instruction and supervision, and I knowingly and freely assume all such risks.

RELEASE AND WAIVER OF LIABILITY

In consideration for being permitted to participate in gym and martial arts activities, I hereby release, waive, discharge, and hold harmless Fox Fitness, its owners, instructors, coaches, employees, contractors, volunteers, and affiliates from any and all claims, demands, causes of action, or liability arising from injury, illness, or property damage sustained while participating in any activities on the premises or during gym-related events, whether caused by negligence or otherwise, to the fullest extent permitted by law.

MEDICAL ACKNOWLEDGMENT

I affirm that I am physically capable of participating in physical exercise and martial arts training. I have no medical conditions that would prevent safe participation, or I have disclosed any such conditions to gym staff prior to participation. I understand it is my responsibility to consult a physician before engaging in strenuous physical activity if I have any concerns.

RULES AND SAFETY

I agree to follow all gym rules, safety guidelines, and instructor directions. I understand that failure to do so may increase the risk of injury and may result in removal from training without refund.

PHOTOGRAPHY & MEDIA (OPTIONAL)

I grant permission for Fox Fitness to use photographs or videos taken during training for promotional or educational purposes, unless I provide written notice otherwise.

I HAVE READ AND FULLY UNDERSTAND THIS WAIVER AND RELEASE OF LIABILITY. I AM SIGNING IT VOLUNTARILY AND AGREE TO BE LEGALLY BOUND BY ITS TERMS.

FOX FITNESS

GYM & MARTIAL ARTS MEMBERSHIP AGREEMENT

This Membership Agreement (“Agreement”) is entered into between Fox Fitness (“Gym”) and the undersigned individual (“Member”).

1. MEMBERSHIP ACCESS & SERVICES

This Agreement grants the Member access to Fox Fitness facilities, equipment, and scheduled programs, which may include strength training, cardiovascular exercise, group fitness, and martial arts instruction such as boxing, kickboxing, Brazilian Jiu-Jitsu, Muay Thai, wrestling, self-defense, and conditioning classes, in accordance with the selected membership plan.

Access to certain programs may be limited by class size, skill level, safety considerations, or instructor approval. Fox Fitness reserves the right to modify class schedules, instructors, or available services at any time.

2. MEMBER RESPONSIBILITIES

The Member agrees to:

• Use all gym equipment and facilities in a safe and responsible manner.

• Follow all posted rules, safety guidelines, and instructor directions.

• Refrain from reckless behavior or actions that may endanger themselves or others.

• Maintain proper personal hygiene and wear appropriate athletic attire.

• Respect other members, instructors, and staff at all times.

• Report any equipment malfunction or unsafe conditions to staff immediately.

Failure to comply with these responsibilities may result in suspension or termination of membership without refund.

3. MARTIAL ARTS PARTICIPATION

The Member acknowledges that martial arts training may involve physical contact, controlled sparring, grappling, or striking techniques. The Member agrees to:

• Participate only within their skill level and follow instructor guidance.

• Use required protective gear when instructed.

• Refrain from unsupervised sparring or training.

• Immediately notify instructors of any injury or discomfort.

Fox Fitness reserves the right to restrict participation in martial arts activities for safety reasons.

4. MEMBERSHIP FEES & PAYMENTS

Membership fees are due according to the selected plan and billing schedule. The Member authorizes Fox Fitness to charge all applicable fees using the provided payment method.

All fees are non-refundable unless otherwise required by law. Failure to make timely payments may result in suspension or termination of membership.

5. CANCELLATION & TERMINATION

The Member may cancel this Agreement by providing written notice to Fox Fitness in accordance with the terms of the selected membership plan.

Fox Fitness may terminate or suspend this Agreement at any time for non-payment, rule violations, unsafe behavior, or misuse of facilities. Termination does not relieve the Member of outstanding payment obligations.

6. HEALTH & MEDICAL ACKNOWLEDGMENT

The Member represents that they are physically able to participate in physical exercise and martial arts training and have no medical conditions that would limit safe participation, or that any such conditions have been disclosed prior to participation.

The Member agrees to immediately stop activity and inform staff if experiencing pain, dizziness, or injury.

7. ASSUMPTION OF RISK & LIABILITY

The Member acknowledges that participation in gym activities and martial arts training involves inherent risks. The Member agrees that participation is voluntary and subject to the separate Liability Waiver executed in connection with this Agreement.

8. PERSONAL PROPERTY

Fox Fitness is not responsible for lost, stolen, or damaged personal property. Lockers are provided for convenience only.

9. PHOTOGRAPHY & MEDIA

Unless otherwise stated in writing, the Member grants Fox Fitness permission to use photographs or videos taken on the premises for marketing or educational purposes.

10. MODIFICATIONS TO AGREEMENT

Fox Fitness may update this Agreement, policies, or rules as necessary. Continued membership after notice of changes constitutes acceptance of the updated terms.

11. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the state or jurisdiction in which Fox Fitness operates.

12. ENTIRE AGREEMENT

This Agreement, together with the Liability Waiver and gym policies, constitutes the entire agreement between the parties and supersedes all prior discussions or understandings.

By signing below, the Member acknowledges that they have read, understood, and agree to the terms of this Membership Agreement.
